These Terms and Conditions regulate and apply to the formalization of the purchase, sale, and ordering of items from Eugénio Campos II, SA (hereinafter referred to as Eugénio Campos Jewels) made by an individual (hereinafter referred to as “User”) on the website www.eugeniocamposjewels.com (hereinafter referred to as the “Website”).

The presentation, sale, and supply of items are the sole responsibility of Eugénio Campos Jewels. Use of the website and purchase of items from Eugénio Campos Jewels implies acceptance of the Terms and Conditions by the User. Eugénio Campos Jewels assumes that the User has read, understood, and taken full note of the procedures set forth herein.

Eugénio Campos Jewels reserves the right to make changes to these Terms and Conditions, applicable to purchase, sale, and order agreements, at any time and without prior notice.

Please note that the agreement will only be accepted and legally valid for Users with legal capacity.

Making a purchase on the website requires the mandatory completion of User data, even if the purchase is made as a guest.

If you create a registration, you have and can access all your data through your personal account, with complete freedom to make changes. Registration and access imply full acceptance of the Terms and Conditions by you.

The items displayed and sold on the Eugénio Campos Jewels website are cataloged in their respective product categories and collections. Each product page contains descriptions and technical details about the item.

Eugénio Campos Jewels undertakes to ensure that the items sold on the website are available, allowing customers to obtain this information. In the event of stock shortages and the impossibility of immediate purchase or shipment, the customer will be informed promptly.

The prices quoted represent the unit price, which includes all applicable taxes. Postal deliveries and accessories may incur an additional charge, which is payable by the customer and will be shown before the purchase is completed. 

 

Purchase process

When making a purchase on the Website, the User can create an account by registering and entering all the requested data.

After registering or entering data, the User can proceed with the purchase process by adding the desired items to the virtual shopping cart. In the virtual shopping cart, the User can always modify the quantity of the desired items (add or remove).

To complete the purchase, the User must select the “Proceed to Checkout” command and enter the requested data regarding the order, billing, shipping, and payment. 

The entry of incorrect or incomplete data will prevent the order process from proceeding, and Eugénio Campos Jewels will not be liable for any losses due to such actions.

Details to be taken into account for correct user conduct: 

  1. Check the items entered and their respective quantities;

  2. Confirm the delivery address, if the User selects the home delivery option, or confirm the point where they wish to collect the order;

  3. Confirm the total order value and select the payment method;

  4. Before finalizing the purchase, confirm the total order value including shipping costs;

  5. After confirming the details and total order value, the customer must accept the Terms and Conditions to complete the purchase.

The customer can track their purchases through the Customer Area.

 

Payment and Billing Process

Eugénio Campos Jewels offers different payment methods, including credit card, MB Way, ATM references, PayPal, Klarna, and Apple Pay.

Payment processes are mediated by Easypay - Instituição de Pagamento Lda, PayPal, and Klarna, to Eugénio Campos Jewels.

Eugénio Campos Jewels guarantees the total security and confidentiality of the data provided, with the details of the card used for payment being transmitted via SSL certificate in encrypted form. 

In order to prevent fraud in transactions and payments made through the website, Eugénio Campos Jewels adopts sophisticated preventive mechanisms that analyze characteristics of purchases that appear to be fraudulent.

To ensure that a transaction is not fraudulent, Eugénio Campos Jewels may request additional information or the provision of supplementary data. 

If the User refuses to provide such additional information, Eugénio Campos Jewels reserves the right not to proceed with the purchase or accept the order.

The User is aware that even though Eugénio Campos Jewels uses advanced technological mechanisms and systems, there may be errors on the part of the system. If this occurs, the User may contact Eugénio Campos Jewels through the means provided in these Terms and Conditions.

For credit card payments, the purchase will only be completed once the respective credit has been verified. If the transaction is rejected by the bank, the purchase will be automatically canceled.

If the amount charged results from a fraudulent transaction or misuse of the customer's card number by third parties, you can request immediate cancellation of the charge through our contact page. Once it has been verified that the purchase was fraudulent, Eugénio Campos Jewels will refund the respective amount.

If it is found that the allegedly fraudulent transaction was actually initiated by the customer and the customer demands its cancellation, they must compensate Eugénio Campos Jewels for the damages resulting from the respective cancellation.

The invoice to be issued will include the information provided by the customer, a breakdown of the prices of the items purchased, the shipping costs, and the applicable VAT. Under no circumstances can the information contained in the invoice be changed.

In the event that the user does not make payment (in a valid and irrefutable manner) within 24 hours, Eugénio Campos Jewels reserves the right to cancel the order.

 

Order Confirmation

The purchase will be completed as soon as the User clicks on the “Pay and Complete Purchase” field and will be confirmed by an email sent by Eugénio Campos Jewels within 24 hours, thereby formalizing the contract of purchase and sale of the items purchased. 

The confirmation email will include the order number that the User must use in any communication with Eugénio Campos Jewels. The order number is mandatory for indicating any changes or inaccuracies in the order. Any charges arising from inaccuracies not reported in a timely manner will be borne exclusively by the User.

If one or more of the items ordered by the User are not available, Eugénio Campos Jewels will notify the customer of their unavailability.

 

Shipping and Delivery

When placing their order, the User can choose from the following options:

 

- Home delivery: With this option, you can choose between delivery up to 72 business hours or URGENT delivery, with delivery set to the next business day, after shipping. For islands shipments, expect anywhere between 5 to 7 business days.

- Pick Up delivery: choose a pick-up point anywhere in the country and collect your order safely and conveniently. After making your purchase, you will receive an email and/or SMS with the code to track your order.

The delivery time for orders is usually 24 to 72 hours, but may be subject to delays due to logistical difficulties, carrier delays, or stock shortages. 

All shipments and deliveries are made to mainland Portugal, the Madeira Archipelago, and the Azores Archipelago. PO boxes are not accepted as delivery addresses.

Upon delivery by the carrier, proof of receipt must be presented to be signed by the User or by the person duly authorized to receive the order. For all intents and purposes, it is assumed that any person at the delivery location indicated by the User has the authority to receive the order. It is the User's responsibility to ensure that someone is present at the address to receive the order.

Shipping costs are the responsibility of the User and vary between countries. Eugénio Campos Jewels will always have the legitimacy and possibility to exempt the user from shipping costs.

Orders are normally delivered within 24 to 72 business hours in mainland Portugal and 5 to 7 business days in the archipelagos, provided that payment has been made by 2 p.m. on the business day on which the order was placed, except in situations arising from logistical difficulties, carrier delays, or stock shortages.

Finally, Eugénio Campos Jewels uses CTT Expresso, DPD, MRW, and DHL as carriers, all of which are express service providers.

 

Campaigns, Promotions, and Discounts

Eugénio Campos Jewels reserves the right to tailor its campaigns, promotions, or discounts (hereinafter referred to as Campaigns) to the destination country to which they are strategically directed.

Campaigns are subject to the conditions indicated for each individual promotion, as well as to these Terms and Conditions of Sale, with the User acknowledging that in the event of a conflict, the rules applicable to the specific conditions of the Campaign in force shall prevail.

If a Campaign aims to offer a good or product and the User exercises their right to cancel or return the purchased product, this also implies the return of the offered product.

Offers received may not be sold or transferred to third parties by the User for the purpose of obtaining, directly or indirectly, economic profit.

The User may waive the free offer, but may not request or obtain any compensation for waiving it.

During the various Campaigns, the offer is only valid after the order has been paid for within a maximum period of 24 hours. Please also note that during the Campaigns, deliveries may be delayed.

Purchases of items in Campaigns (promotions, discounts, or offers) are valid upon presentation in the online boutique and can be consulted in the Frequently Asked Questions section. All campaigns have limited stock and conditions may be changed at the discretion of Eugénio Campos Jewels. In the event of spelling, pricing, stock, or other errors, Eugénio Campos Jewels reserves the right to cancel the user's order.

Finally, Eugénio Campos Jewels reserves the right to cancel all unpaid orders within 24 hours of the order being placed or in the event of stock/availability issues.

 

Exchanges, Returns, and Cancellations

When purchasing items from Eugénio Campos Jewels through the Website, customers have the right to freely cancel their purchase under the terms of Article 11 of Decree-Law 24/2014 of February 14.

We are dedicated to providing excellent service to our customers. In line with this care and concern, we offer a service that allows you to return your items within a cooling-off period of up to 30 days or exchange the item for another of equal or greater value within 30 days, both from the date of purchase, or cancel the order within 14 days from the date of receipt of the order, with each case being handled individually.

Upon arrival, the Eugénio Campos Jewels team will carry out a quality control process on the item(s), validating the exchange, return, or cancellation.

Once the exchange, return, or cancellation has been accepted, the following rules apply:

  • Exchange of items: if you exchange an item for one of a higher value, the additional amount will be charged using the same payment method used for the initial order, unless expressly agreed otherwise and provided that the consumer does not incur any costs as a result of the refund.
  • Return of items: once the purchase price has been refunded, Eugénio Campos Jewels will refund the amount using the same payment method used by the consumer in the initial transaction, unless expressly agreed otherwise and provided that the consumer does not incur any costs as a result of the refund. Refunds will only be made after receipt of the returned items;
  • Cancellation: once the purchase has been canceled, Eugénio Campos Jewels will refund the amount using the same payment method used by the consumer in the initial transaction, unless expressly agreed otherwise and provided that the consumer does not incur any costs as a result of the refund. Returned products must be in saleable condition, i.e., in the same condition in which they arrived in the consumer's hands, without any anomalies or damage. Refunds will only be made after receipt of the returned items. Eugénio Campos undertakes to refund the consumer within a maximum period of 10 days.

Special considerations:

  • With regard to personalized items, Eugénio Campos Jewels does not accept any exchanges or returns, due to their specific nature;
  • When sending one or more items for exchange, return, or cancellation, the customer (user or buyer) is responsible for the proper use, safety, and adequate shipping of the items to the address of Eugénio Campos Jewels. Therefore, we are not responsible for any damage or loss resulting from this shipping process.
  • The user is responsible for the costs associated with shipping their items for exchange or return.

If you receive an incorrect or defective item, please contact our team directly by accessing the contact details. This way, we can give priority and special attention to the return and refund or exchange process.

 

After-Sale Services

Items sold by Eugénio Campos Jewels are covered by a 3-year manufacturer's warranty. After the warranty expires, Eugénio Campos Jewels provides technical assistance. Defective or damaged items should be reported using the options provided on the contact page. If the repair incurs costs for the User, they will be informed in advance and the repair will only be accepted after their approval.

 

Warranty

During the warranty period, any item with a manufacturing defect will be repaired free of charge or replaced with a similar model.

In cases where it is not possible to repair the item, the User must present the non-compliant item, together with the original warranty certificate, duly and completely filled out (indicating the date of purchase, name and address, and the reference number assigned to the item—when applicable—or product name) and the purchase invoice or other suitable proof of purchase.

Materials subject to breakage, loss, theft, deterioration, oxidation, defects caused by impact, including deformations caused by daily and/or inappropriate use, improper maintenance and cleaning, negligence, mishandling, modifications to the original product, and repairs not authorized by the brand are excluded from the warranty.

The warranty conditions are governed by Decree-Law No. 84/2021, of October 18, which regulates consumer rights when purchasing goods, under Directives (EU) 2019/771 and (EU) 2019/770, of May 20. Among other rules, the law establishes:

  • Consumer rights in the event of non-conformity (namely defects) of movable goods and others;
  • Extension of the warranty period for goods from 2 to 3 years, with the consumer having to prove that the defect existed at the time of delivery of the goods in the third year;
  • An additional period of six months if the consumer opts to have the goods repaired (up to a maximum of 4 repairs);
  • The “right of rejection” which allows consumers to freely choose between replacement of the goods and termination of the contract when the non-conformity becomes apparent within the first 30 days of delivery;

Pricing Policy
